1.2. Acceptance of Terms and Conditions
By accessing this site and making transactions through the MileagePlus Merchandise Awards site, specifically by clicking the "I agree" and similar buttons, you expressly indicate your acknowledgment and acceptance of the MileagePlus Merchandise Awards site terms and conditions. MileagePlus, at its sole discretion, may adopt, modify or remove terms and conditions regarding this program at any time without notice. MileagePlus has the sole right to interpret and apply the terms and conditions as they see fit.
1.3. Acceptance of Electronic Communication
You hereby consent to receive electronic communications, including merchandise purchase confirmation, from MileagePlus, its Services Provider and product merchants whether addressed to the email address associated with your MileagePlus account or other email address that you provide. You acknowledge and agree that any communication via email or postings on MileagePlus Merchandise Awards satisfies any legal requirements that such communications be made in writing.
Merchandise Awards may be shipped only to an address in the 48 contiguous United States. MileagePlus reserves the right to establish eligibility criteria for redemption of awards. Eligibility may vary by member. The awards consist of any goods or services purchased by you and distributed by independent merchants that make available such awards directly to you via the MileagePlus Merchandise Awards site. Awards issued are subject to the rules of the MileagePlus program. MileagePlus, its subsidiaries, affiliates and agents are not responsible for any products and services of other participating companies and partners.
1.5. Relation between You and Merchant
Every time you purchase an award via the MileagePlus Merchandise Awards site, you enter into an agreement directly with the merchant offering the applicable product. MileagePlus, its affiliates and its Services Provider only provide the access and the technical platform for you to redeem awards directly from the merchant. You agree and acknowledge that separate terms and conditions of the relevant merchant may apply to any award redemptions via the MileagePlus Merchandise Awards site. You agree to abide to such applicable terms and conditions, including but not limited to, rules and restrictions on availability, shipment and delivery terms, notification of defects, return and refund policies, money back guarantees and claim for damages. Neither MileagePlus nor its affiliates or Services Provider becomes party to the transaction between you and the merchant. MileagePlus and applicable merchants are not responsible for errors and/or omissions in any transaction
1.6. Use of MileagePlus Merchandise Awards site
You may only use the MileagePlus Merchandise Awards site to make non-commercial, legitimate award purchases and shall not use the site for any other purposes, including making any speculative, false or fraudulent transactions or award purchases or other award redemptions. Awards on the site are subject to availability at the time of booking. By accessing and/or using the MileagePlus Merchandise Awards site, you authorize MileagePlus, its affiliates and the Services Provider to consider any person using your information a legitimate user. Awards can be redeemed only by the MileagePlus member personally. Members/legal guardians must ensure that the log-in details are not used illegally or improperly. MileagePlus and its affiliates and Services Provider bear no responsibility for any consequences of illegal or improper use of the personal details. MileagePlus and its affiliates reserve the right to terminate membership in accordance with the MileagePlus Program Rules.

In its discretion, at any time, and for any or no reason, MileagePlus may prevent or restrict access to this MileagePlus Merchandise Awards site or any part thereof for all or certain users or MileagePlus members, with or without notice. Access may vary by user. Any actual or suspected fraudulent, abusive, or illegal activity is grounds for termination of your access to this website in MileagePlus’ discretion and may be referred to appropriate law enforcement authorities. These remedies are in addition to any other remedies MileagePlus may have pursuant to the MileagePlus Program Rules or at law or in equity. By making transactions via the MileagePlus Merchandise Awards site, you confirm that you are not breaching any laws in your country of residence regarding the legality of such use. MileagePlus, its affiliates and the Services Provider will not be held responsible (i) for the exclusion of certain MileagePlus members from MileagePlus Merchandise Awards site and (ii) for any unlawful use of the MileagePlus Merchandise Awards site.

3. Award Redemption
3.1. Merchandise (Buying)
Through this redemption type, you have the possibility to purchase awards from partners in exchange for miles (or, where applicable for a limited number of products, a combination of award miles and money). Offer and pricing are subject to change without notice and may vary by member. Certain members may receive preferential pricing. Other restrictions may apply. All award orders are subject to availability. You will be notified if the award you have ordered is not available and if and when it will become available. We reserve the right to substitute items of equal or greater value. We will ship the model pictured or the most current comparable model available. Items shown are the latest models available at the time of placing your order.
4. Award Payment
4.1. Payment with Miles
You may purchase an award for such amount of Miles (or a combination of award miles and money) as indicated for each award in the MileagePlus Merchandise Awards site, provided that you have sufficient award miles available on your account at the time of purchase. Miles that are not yet accrued and credited to your account at the time you place the purchase order are not available for award purchase. You may not combine miles from two or more accounts on a single transaction. Miles are deducted from your account as soon as an award is purchased. In the event that miles have not been properly debited from your account at the time of redemption, such miles may be debited by United at any time.
4.2. Payment with Miles and Money
MileagePlus may permit certain Members to purchase the products using a combination of award miles and money. MileagePlus, in its sole determination, may require a minimum number of miles to be used for any such award purchase. MileagePlus reserves the right to change, the cash amount and the miles amount needed for such award purchase and for such amounts to vary by member, as well as the right to change or terminate the offer at any time, sole discretion. Any money payment must be paid using a credit card or debit card.
4.3. Conversion into Cash
The conversion of miles into a cash amount and the payment of such cash amount to you or any similar transactions are not possible, not even in case of return of the award or services or the cancellation of MileagePlus membership.
5. Shipping, Handling and Return of Awards
Shipping, handling, returns and other delivery related terms and conditions are as set out in the relevant offer details on the MileagePlus Merchandise Awards site.
Awards are sent only to the address associated with the member's MileagePlus account or to such other address as explicitly provided with a specific award order. Delivery dates cannot be guaranteed and MileagePlus, its affiliates or its Services Provider assumes no liability for failed deliveries caused by incorrect addresses, absence of the recipient, customs issues, force majeure or other reasons not under the reasonable control of MileagePlus or the Services Provider. Awards will not be delivered to P.O., A.P.O. or F.P.O. boxes. Awards can be shipped only to addresses in the 48 contiguous United States with limited exceptions. If you want to ship to an address other than the address associated with your account, please update the shipping information during the online check-out process. Addresses cannot be changed after order has been made. On a case by case basis, orders may be shipped outside of the 48 contiguous United States to Alaska or Hawaii on an exception only basis. Orders will not be shipped internationally. Please contact the applicable merchant directly regarding your exception request. Please note that additional shipping charges payable by miles may apply if an item is shipped outside of the contiguous United States.
Items ordered at the same time may arrive separately. The cost of regular shipping and handling is included in the cost for each item. Awards will be delivered to your door within 3-4 weeks of placing the order, with the exception of truck-shipped items, which may take up to 8 weeks.
5.3. Velvet Glove Service and Truck-Shipped Items
For items that are specified as Velvet Glove, you will receive full Velvet Glove service, which includes delivery to a room of choice (access permitting), unpackaging and removal of packaging materials.
For Truck shipped items (first threshold delivery) including some TVs and GE/Weber items, the item will not be unpacked or brought to a room of choice. It will be signed for at door.
For large workout equipment, item will be brought to a room of choice (access permitting) but it will not be unpackaged. This is so that small pieces required for assembly are not lost.
For all truck shipments, there is no removal of any existing items. Allow up to 8 weeks for delivery.
If a truck shipped award arrives damaged, please refuse delivery. If unable to refuse, damage must be reported within 5 calendar days to Award Partner.
5.4. Fees and Taxes
The prices on the Award site include all applicable sales taxes and shipping and handling fees unless otherwise specified.
5.5. Refunds and Returns
Miles (and, if applicable, miles and money) are not refundable once an award purchase has been made. Product awards may not be returned or exchanged unless proven to be damaged or defective, and must be returned within 30 days of delivery. Problems or complaints with awards should be directed to customer service as described below under "Merchandise Return Policy".

Damage or defective merchandise: All damaged or defective items must be returned within 30 days of delivery. No exchanges or returns are accepted after 30 days. Please the applicable merchant directly. To find the contact information for the applicable merchant, please view your purchase.
If product rewards are visibly damaged, please refuse the product and contact the applicable merchant directly. To find the contact information for the applicable merchant, please view your purchase history. Products must be in their original packaging (with the exception of Velvet Glove Service) and include batteries, cables, remote controls, etc.
Under special circumstances approved by MileagePlus, products purchased with award miles may be returned for full mileage credit, less a 15% restocking fee of redeemed miles.
If received product rewards are missing parts or otherwise incomplete, you MUST keep the shipment carton, shipping labels and all packaging materials, boxes and parts in order to return the reward and/or receive a replacement part or reward. You should contact the applicable merchant immediately to inform of missing parts and to initiate a claim. NOTE: All packaging must be made available for common carrier inspection in order to receive replacement parts or reward.
No exchanges or returns on jewelry, perishables and wearables.
Miles (or, if applicable, miles and money) will not be refunded for returned items after 30 days, and will not be refunded for items altered in any way from original condition.

When purchasing items through the MileagePlus Merchandise Awards site, you enter into an agreement with the relevant merchant provider of the award, and not with MileagePlus, its affiliates or its Services Provider. You expressly acknowledge and agree that merchants are independent contractors and not employees or agents of MileagePlus, its affiliates or the Services Provider. Neither MileagePlus, its affiliates nor its Services Provider is liable for the acts, errors, omissions, representations, warranties or negligence of the merchants. MileagePlus, its affiliates and its Services Provider shall not be responsible for or liable to you in connection with any restrictions, qualifications, or other terms and conditions imposed by the merchant on any award items. As far as permissible by applicable law, MileagePlus, its affiliates and the Services Provider hereby disclaim any award or other liability, whether based on contract, tort, strict liability or otherwise, including without limitation liability for any direct, punitive, special, consequential, incidental or indirect damages, in connection with the awards provided by any merchant through the MileagePlus Merchandise Awards site, including without limitation liability for any act, error, omission, injury, loss, accident, delay, or irregularity which may be incurred through the fault, negligent or otherwise, of such partner and you hereby expressly exonerate MileagePlus, its affiliates and Services Provider from any liability with respect to the same. To the extent permitted by law, MileagePlus, its affiliates and the Services Provider exclude all liability to you or other person of whatsoever nature in respect of any negligence, willful misconduct, poor service or other breach of obligation arising out of the provision or failure to provide the services by or on behalf of a merchant.

MileagePlus, its affiliates and the Services Provider do not warrant or represent that the content on the MileagePlus Merchandise Awards site or any website linked to the MileagePlus Merchandise Awards site is complete or up-to-date, including but not limited to with respect to product images or model numbers. MileagePlus, its affiliates and the Services Provider are under no obligation to update any content on the MileagePlus Merchandise Awards site. MileagePlus may change the content on or make improvement or changes of the MileagePlus Merchandise Awards site at any time without notice. The information, awards, and descriptions of awards and other services published on or linked from the MileagePlus Merchandise Awards site may include inaccuracies or typographical errors, and MileagePlus, its affiliates and its Services Provider specifically disclaim any liability for such inaccuracies and errors.
7.3. Limitation of Liability
You agree that MileagePlus, its affiliates, the Services Provider and all of their respective officers, directors, employees and agents will not be liable, whether in contract, tort, strict liability or otherwise, for any indirect, punitive, special, consequential, incidental or indirect damages (including without limitation lost profits, cost of procuring substitute service or lost opportunity) arising out of or in connection with the use of the MileagePlus Merchandise Awards site, or with the delay or inability to use the MileagePlus Merchandise Awards site or a linked MileagePlus Merchandise Awards site, even if MileagePlus is made aware of the possibility of such damages. This limitation on liability includes, but is not limited to, the transmission of any virus which may infect your equipment, failure of mechanical or electronic equipment or communication lines, telephone or other interconnect problems, unauthorized access, theft, operator errors, strike or other labor problems or any force majeure. MileagePlus cannot and does not guarantee continuous, uninterrupted or secure access to the MileagePlus Merchandise Awards site.
7.4. Legal Remedies
MileagePlus reserves the right to seek all remedies available at law and in equity for any misuse of the MileagePlus Merchandise Awards site and/or violations of these rules, including the right to block access from a particular internet address and to exclude you from accessing the MileagePlus Merchandise Awards site.
8. Copy Rights and Trade Marks
The trademarks, logos and service marks ("Marks") displayed on the MileagePlus Merchandise Awards site are the property of MileagePlus, its affiliates, the Services Provider, the merchant or other Mark owner as the case may be. You are prohibited from using any Marks for any purpose including, but not limited to, the use as meta-tags on other pages or sites on the World Wide Web without the written permission of MileagePlus, or such other party which may own the Marks. All information and content including any software programs available on or through the site ("Content") is protected by copyright. You are prohibited from modifying, copying, distributing, transmitting, displaying, publishing, selling, licensing, creating derivative works or using any Content available on or through the site for commercial or public purposes.
9. Confidentiality of Personal Information
Access to and use of password protected and/or secure areas of the MileagePlus Merchandise Awards site is restricted to authorized persons only. Unauthorized individuals attempting to access these areas of the MileagePlus Merchandise Awards site may be subject to prosecution. You are responsible for maintaining the confidentiality of your personal information, including your account and password, and for restricting access to your computer to prevent unauthorized access to the MileagePlus Merchandise Awards site. You agree to accept responsibility for all redemption and other activities that occur under your account or password. You should take all necessary steps to ensure that the password is kept confidential and secure and should inform MileagePlus immediately if you have any reason to believe that your password has become known to anyone else, or if the password is being, or is likely to be, used in an unauthorized manner.
Miles accrued, awards, and benefits issued are subject to change and are subject to the rules of the United MileagePlus program, including without limitation the Premier® program (the “MileagePlus Program”), which are expressly incorporated herein. Please allow 6-8 weeks after completed qualifying activity for miles to post to your account. United may change the MileagePlus Program including, but not limited to, rules, regulations, travel awards and special offers or terminate the MileagePlus Program at any time and without notice. United and its subsidiaries, affiliates and agents are not responsible for any products or services of other participating companies and partners. Taxes and fees related to award travel are the responsibility of the member. Bonus award miles, award miles and any other miles earned through non-flight activity do not count toward qualification for Premier status unless expressly stated otherwise. The accumulation of mileage or Premier status or any other status does not entitle members to any vested rights with respect to the MileagePlus Program. All calculations made in connection with the MileagePlus Program, including without limitation with respect to the accumulation of mileage and the satisfaction of the qualification requirements for Premier status, will be made by United Airlines and MileagePlus in their discretion and such calculations will be considered final.
